1. About these terms
These Terms of Service ("Terms") govern your purchase of pillows and related products from our online store at kodushome.ca. By placing an order with us, you agree to these Terms in full.
These Terms apply to retail purchases by individual consumers. They do not apply to wholesale or trade orders, to custom or made-to-order goods produced to a customer's specification, or to cushion and sofa filling services supplied to furniture manufacturers and trade customers. Those engagements are governed by separate written terms agreed with you at the time of order.
Purchases made through Amazon Marketplace are subject to Amazon's terms and policies, not to these Terms.
2. Eligibility and accounts
You must be at least 18 years of age to enter into a contract with us, or the age of majority in your province of residence. You are responsible for the accuracy of the information you provide and for keeping any account credentials secure.
3. Products
We sell pillows and bedding products filled with down, down alternative, microgel, microfiber, feather, kapok and custom blends. Because these are filled products, the exact loft, firmness and weight of each pillow may vary slightly from item to item. This variation is inherent to the product and does not constitute a defect.
Product images are for illustration. We aim to represent colours and materials accurately, but screens vary and we cannot guarantee exact colour reproduction.
4. Pricing and payment
- All prices are shown in Canadian dollars (CAD) and exclude applicable taxes, duties and brokerage charges, which are the customer's responsibility.
- Prices and availability may change without notice, but we will never charge you a price different from the price shown when your order was placed.
- Payment is due at the time of order. We accept the payment methods shown at checkout.
- We may refuse or cancel an order where we reasonably suspect fraud, payment error, or where stock is unavailable. Where we cancel an order that has already been paid for, we will refund you in full.
5. Order acceptance
Your order is an offer to buy. A contract is formed only when we accept your order and dispatch the goods. We may decline an order for any lawful reason, including but not limited to errors in pricing, suspected fraud, or an inability to fulfil the order.
6. Shipping and delivery
- Delivery dates are estimates and are not guaranteed unless expressly stated.
- Risk of loss in transit passes to you when the goods are delivered to you, or to the address you provided at checkout. Please provide a delivery address where someone can receive the parcel.
- If your parcel arrives visibly damaged, note it with the carrier before signing where possible, and contact us within 7 days of delivery with photographs.
- Any duties, taxes, brokerage, or import fees are payable by the customer.
7. Cancellation
You may cancel an order within 1 hour of placing it, and in any case before it is fulfilled and shipped. After an order has shipped, the Return and Refund Policy applies.
8. Returns and refunds
Returns are accepted within 7 calendar days from delivery, for items that are unopened, unused and in their original packaging. The customer is responsible for all return shipping costs. Full terms, exclusions, and refund timing are set out in our Return and Refund Policy, which forms part of these Terms.
9. Warranty and product quality
We warrant that goods purchased from us are of acceptable quality and free from material defects in manufacture. If your goods fail within a reasonable period, contact us and we will, at our option, repair, replace, or refund the affected goods.
This warranty does not, and is not intended to, limit or exclude your rights under the Consumer Protection Act, 2002 (Ontario), the Sale of Goods Act, or any other applicable legislation. Your statutory rights in respect of defective goods are unaffected by these Terms.
10. Product care and safety
Pillows and fillings are not suitable for infants or for use as sleep surfaces for babies. Follow the care instructions provided with your product. Improper use, or use contrary to the care instructions, is not covered by any warranty remedy under these Terms.
11. Limitation of liability
To the fullest extent permitted by law, Kodus Home Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data arising from your use of the site or products.
Our total aggregate liability to you for any claim relating to an order is limited to the amount you paid for the order in question.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited under the Consumer Protection Act, 2002 (Ontario) or any other applicable law.
12. Intellectual property
The Kodus Home name, our logo, product designs, site content, photography, and text are our property or licensed to us. You may not copy, reproduce, or use them commercially without our written permission. Our brand name and logo may not be used to imply endorsement without permission.
13. Third-party links
Our site may contain links to third-party sites. We do not control and are not responsible for their content, privacy practices, or availability. A link does not imply endorsement.
14. Privacy
We collect and handle personal information in accordance with applicable privacy law, including the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada. Our Privacy Policy explains what we collect and how we use it.
15. Changes to these Terms
We may update these Terms from time to time. The version in effect at the time you place your order applies to that order. Continued use of the site after changes are posted constitutes acceptance of the updated Terms.
16. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be subject to the exclusive jurisdiction of the courts of Ontario, without prejudice to any mandatory consumer protections available to you where you live.
17. Severability and waiver
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. A failure to enforce any provision is not a waiver of that provision.
